Parmi les préoccupations de la traduction est de combler le vide dans une langue donnée en lui ajoutant de nouveaux concepts empruntés à une autre langue, ce qui lui permet de s’enrichir. L’emprunt est la solution pour désigner des réalités inexistantes dans la langue d’arrivée, c’est le procédé le plus approprié pour traduire des termes exprimant des réalités culturelles présentes dans la langue de départ et totalement absentes dans la langue d’arrivée. Le corpus choisi pour cet article est constitué essentiellement du code algérien de la famille par sa richesse en emprunt. Nous étudions ce phénomène dans ce texte juridique à l’image des autres textes de loi.
