Konflikte und ihre Folgen haben die Menschheit seit Anbeginn der Zeit geplagt. Heute gibt es weltweit 10 Millionen staatenlose Menschen (UNHCR, 2016). 26 % dieser Menschen sind in Afrika südlich der Sahara untergebracht (UNHCR, 2016). Die Rechte von Flüchtlingskindern sind in der Republik Südafrika ein wichtiges Thema. In der fortschrittlichen Verfassung Südafrikas (1996) ist das Recht aller Kinder auf Zugang zu Bildung ohne Diskriminierung verankert. In diesem Buch wird ein auf Rechten basierender Ansatz für die Bildungsforschung verwendet, um einige der Faktoren zu ermitteln, die den Zugang von Kinderflüchtlingen zu Bildung in Südafrika fördern oder behindern, wobei der Schwerpunkt auf Kapstadt liegt. Mabel befragte Akteure der Zivilgesellschaft, Schulbehörden und Eltern von Flüchtlingskindern in Kapstadt, um den Kontext besser zu verstehen. Obwohl das südafrikanische Schulgesetz (1996) und andere Instrumente einen Rahmen für den Zugang aller Kinder zur Schulbildung bilden, wird die praktische Umsetzung dieser und anderer politischer Maßnahmen auf Schulebene von der Auslegung und Anwendung der Politik durch Schulverwaltungen und Flüchtlingseltern beeinflusst. Die Diskrepanz zwischen Politik und Umsetzung ist eine ständige Bedrohung für einen besseren Zugang von Flüchtlingskindern zur Schulbildung.
