O objetivo do presente trabalho é descobrir se e como os trabalhadores com direito à pensão podem continuar a ser empregados para combater a escassez de pessoal. A nova regulamentação do § 41, frase 3, do SGB VI já é vista por muitas empresas como uma saída, mas, do ponto de vista jurídico, envolve um risco elevado e, idealmente, deve ser alterada novamente pelo legislador. O processo de trabalho consiste, por um lado, em analisar e interpretar textos legais. Da mesma forma, neste livro foi elaborado um modelo para empresas, a fim de contornar os riscos do § 41, frase 3. Por outro lado, o Tribunal Regional do Trabalho de Bremen oferece um exemplo prático dos riscos associados ao § 41, frase 3, do SGB VI. Vantagens, desvantagens e sugestões para melhorar a disposição completam a tese. Além disso, foram incluídas várias opiniões para apresentar uma variedade de perspetivas sobre a lei prevista.
