O presente trabalho procura demonstrar que o legislador ordinário, ao editar o Código Civil de 2002, exorbitou em sua atividade legislativa ao criar uma indevida diferenciação de tratamento sucessório entre o cônjuge supérstite e o companheiro sobrevivente, não autorizada pelo legislador constituinte, violando assim os princípios da dignidade da pessoa humana, da igualdade, do devido processo legal substantivo e da vedação de retrocesso social, o que implica no reconhecimento da inconstitucionalidade desses dispositivos legais discriminatórios, a fim de que seja restabelecida a paridade de tratamento hereditário entre o cônjuge e o companheiro. 10
