La maternità surrogata compromette la dignità del bambino, rendendolo oggetto di un contratto - una merce. Compromette inoltre la dignità della madre, anche se la sua partecipazione è volontaria, trattandola semplicemente come un utero a noleggio. L’infertilità è considerata un problema grave, poiché i legami di parentela e familiari dipendono dalla prole. È qui che la maternità surrogata si presenta come la salvatrice per eccellenza. Una donna è rispettata come moglie solo se è madre di un figlio, in modo che la mascolinità e la potenza sessuale del marito siano dimostrate e il lignaggio continui. Alcuni autori lo esprimono come segue: i genitori costruiscono il bambino biologicamente, mentre il bambino costruisce i genitori socialmente. Purtroppo, alcune donne, a causa di determinate condizioni fisiologiche, non possono dare alla luce figli propri. Il desiderio di maternità le spinge a cercare soluzioni alternative, e la maternità surrogata si presenta come l’alternativa più praticabile. Strutture mediche a basso costo, competenze tecnologiche avanzate nel campo della riproduzione, unite a condizioni socio-economiche precarie e alla mancanza di leggi normative in India in materia, si combinano per rendere l’India un’opzione attraente.
