Leihmutterschaft führt zu einer Beeinträchtigung der Würde des Kindes, indem sie das Kind zum Gegenstand eines Vertrags - zu einer Ware - macht. Sie beeinträchtigt zudem die Würde der Mutter, selbst wenn ihre Teilnahme freiwillig ist, indem sie lediglich als „Leihmutter' behandelt wird. Eine Frau wird nur dann als Ehefrau respektiert, wenn sie Mutter eines Kindes ist, damit die Männlichkeit und sexuelle Potenz ihres Mannes unter Beweis gestellt wird und die Abstammungslinie fortgeführt wird. Einige Autoren formulieren es wie folgt: Die Eltern erschaffen das Kind biologisch, während das Kind die Eltern sozial erschafft. Leider können manche Frauen aufgrund bestimmter physiologischer Umstände keine eigenen Kinder zur Welt bringen. Der Wunsch nach Mutterschaft veranlasst sie, nach alternativen Lösungen zu suchen, und die Leihmutterschaft bietet sich als die praktikabelste Alternative an. Kostengünstige medizinische Einrichtungen, fortschrittliches Know-how im Bereich der Reproduktionstechnologie, gepaart mit schlechten sozioökonomischen Bedingungen und einem Mangel an einschlägigen Gesetzen in Indien, machen das Land in dieser Hinsicht zu einer attraktiven Option.
