Einleitung„Eine Krähe hackt der anderen kein Auge aus' so lautet ein bekanntes deutsches Sprichwort. Dieses lässt sich auf das Verhalten der Justiz im Westen Deutschlands nach 1945 anwenden. In der BRD wurde kein Jurist, der in der NS-Zeit willkürliche Urteile - mitunter Todesstrafen - ausgesprochen hat, verurteilt. Dies lässt vermuten, dass die Juristen nach 1945 ihre belasteten Kollegen vor einem Schuldspruch geschützt haben.Inwieweit haben die bundesdeutschen Juristen ihre Kollegen in Schutz genommen und sie vor einer Verurteilung bewahrt? Diese Frage möchte ich versuchen im Folgenden zu beantworten.Zunächst werde ich die Bedeutung der Juristen im Dritten Reich erläutern. Im Anschluss daran erfolgt eine Betrachtung der Entnazifizierung der Juristen von Seiten der Alliierten, wobei ich besonders auf die schrittweise Renazifzierung der Juristen durch das Gesetz 131 sowie auf den Nürnberger Juristenprozess Bezug nehmen werde. Ein wichtiger Grund, weshalb es zu keiner Verurteilung der belasteten Juristen kam, ist der Missbrauch der Radbruch’schen Formel, auf die man sich immer wieder berufen hat, um das Unrecht, das begangen wurde, zu legitimieren. Die Radbruch’sche Formel bildet den nächsten Punkt meiner Untersuchung. Ein Beispiel für die Anwendung der Radbruch’schen Formel ist der Fall Rehse, bei dem es letzten Endes zu einem Freispruch kam, obwohl Hans-Joachim Rehse in seiner Tätigkeit als Richter am Volksgerichtshof mehr als 230 Todesurteile ausgesprochen hat. Weitere Untersuchungspunkte meiner Arbeit werden die Anschuldigungen der DDR Ende der fünfziger Jahre sein und die Reaktion der deutschen Justiz darauf. Abschließend werde ich auf den letzten gescheiterten Versuch der Entnazifizierung der Juristen eingehen - dem Volksgerichtshofverfahren. In
