Vorbetrachtung Die Goldene Bulle von 1356 (Bulla Aurea1 ) ist als ein „Kaiserliches Rechtbuch'2 Karls IV. (1316- 1378) zu verstehen, das die Probleme zurückliegender Königswahlen zu umgehen versuchte, und die Kurfürsten auf ein Gesamtgesetz verpflichtete. Die Zeit einer Gesetzesgebung war günstig, denn nachdem Karl in Rom 1355 zum Kaiser gekrönt worden war, befand sich nun erstmals wieder ein anerkannter und vom Papst gekrönter Kaiser auf dem Thron.3Bei dem Hoftag zu Nürnberg am 10. Januar 1356 wurde ein Teil der Urkunde, Kapitel I - XXIII, in Gegenwart der deutschen Reichsstände, erstmals als Bestimmung Karls IV. verlesen. An einem zweiten Hoftag zu Metz am 25. Dezember 1356, wurde das Gesetz durch die Kapitel XXIV- XXXI , in Anwesenheit des Papstes Innozenz VI. und des zukünftigen Königs von Frankreich Karl V., vervollständigt.Die Quelle cap. II aus der Goldenen Bulle dient dieser Arbeit als Ausgangspunkt für eine strukturelle Durchdringung des Themas. Hierbei wurden insbesondere die vorgegebenen Leitfragen berücksichtigt und ausgearbeitet, die im Speziellen zur Interpretation und Diskussion der Goldenen Bulle dienen. Im Folgenden wird mit dieser Arbeit der Versuch erbracht, die Fragen nach dem Wie, Wann und Wo des Gesamtwerkes zu beantworten. Hierzu gliedert sich der Aufsatz, angefangen mit einer Erörterung zur Entstehung des Gesetzwerkes, in mehrere Abschnitte mit unterschiedlichen Themen, die folglich zu einer Analyse der aus der Goldenen Bulle entstandenen Konsequenzen und Ergebnisse führen. Ferner vergleicht die schriftliche Ausarbeitung das Nürnberger Gesetz mit einem weiteren legislatorischen Werk des Karl IV. und bildet Rückschlüsse über eventuell herangezogene Vorbilder für das Wahlverfahren.
