Juli 1198 krönte der Kölner Erzbischof Otto IV. in der Pfalzkapelle in Aachen mit eigens angefertigten Insignien, da sich die ‚echten’ Reichsinsignien in der Hand Philipps von Schwaben befanden, der erst am 08. September von Erzbischof Aimo von Tarentaise in Mainz gekrönt wurde. Beide Königserhebungen wiesen insofern Mängel auf, als sie nicht in allen Teilen den üblichen Rechtsgewohnheiten entsprachen. [...] Doch diese Kriterien reichten nicht aus, um zu entscheiden, welcher der beiden Kandidaten der rechtmäßige König war. [...] So argumentierte Innocenz III. in der Bulle ‚Venerabilem’, daß Otto von der Mehrheit der Fürsten gewählt worden sei, denen nach Recht und Gewohnheit die potestas zur Wahl des Königs und künftigen Kaisers zustehe'.
