Das Buch analysiert die tragenden Säulen der Verfassungsrechtsentwicklung auf empirischer Grundlage. Es baut dabei auf den Theorien Poppers, Kuhns und Kelsens auf und passt diese an, um die theoretische Erfassung von Staatsrecht als beobachtbares soziales Phänomen zu maximieren. Dieser Ansatz findet Verwendung, um neues Licht auf verschiedene Aspekte der Verfassungsentwicklung zu werfen, konkret auf die Ursprünge in und aktuelle Verflechtung mit dem europäischen Rechtsraum; das System des Grundrechtsschutzes mit besonderer Beachtung der Kommunikations- und Religionsfreiheit; das System der Gerichtsbarkeit öffentlichen Rechts; und die generell-abstrakte Dimension gerichtlicher Rechtschöpfung. Dies erlaubt Rückschlüsse auf eine Theorie der rechtstatsächlichen Verfasstheit. Dabei wird die besondere Rolle von Paradigmen für den Ursprung, die Stabilisierung und das Ende von autopoietischen Systemen positiven Staatsrechts deutlich.
