No seu livro, Unprecedented: The Constitutional Challenge to Obamacare (2013), o professor Josh Blackman apresenta três conclusões principais: (1) a Lei de Proteção ao Paciente e Cuidados Acessíveis de 2010 (ACA/Obamacare) foi inédita em vários aspetos; (2) apesar de o Supremo Tribunal ter acabado por votar a favor da manutenção de quase toda a ACA, o litígio foi, em muitos aspetos, uma vitória substancial para o movimento jurídico conservador; e (3) na medida em que o presidente do Supremo Tribunal Roberts pode ter mudado a sua posição no caso em algum momento entre o seu voto inicial após a argumentação oral e a sua decisão final, isso foi provavelmente o resultado de um desejo de preservar a legitimidade do tribunal a longo prazo num contexto de pressão política e mediática liberal. Esta análise contesta cada uma destas três conclusões, apresentando o argumento de que: (1) a ACA, embora seja uma legislação importante, não é assim tão sem precedentes; (2) o resultado do litígio foi uma derrota substancial para o movimento jurídico conservador; e (3) a provável mudança na posição do presidente do Supremo Tribunal Roberts deveu-se mais à dinâmica da redação interna do parecer do tribunal do que à pressão política e mediática externa.
