This paper will attempt to explain the position that the state should take in the face of new trends in online communication. Based on a historical review of Argentina, it will demonstrate the position taken by the different governments in the classic media field, in terms of radio and television, and will set out the theoretical content in order to begin to consider whether a legal system is necessary to deal with content on the net or whether the way forward is self-regulation of the sector by its main components. This study will seek to provide the reader with elements of understanding of what has happened in the past, but with the intention of providing resources for the future regarding the advance of audiovisual content on the web. Undoubtedly, from the author’s point of view, the new era poses the need to think about what to do with audiovisual content that is conceived and transmitted exclusively on the internet, leaving aside traditional media. This is the challenge that journalists, lawyers and states will have to face in order to ensure that one of the most important values always prevails: freedom of expression.
