Can the fact that the person concerned is, according to his own statement, certain that he is no longer under the influence of the drug and feels undoubtedly capable of driving a motor vehicle safely, negate the accusation of negligent conduct, even though he could not completely rule out the possibility that a residual amount of THC or its metabolites was still detectable in his blood at the time he started driving? The aim of this book is to clarify this question, which regularly arises in the course of legal discussions on the legal interpretation of Section 24a of the Road Traffic Act (StVG).
