Mit der Untersuchung des Menschenhandels zur Ausbeutung der Arbeitskraft (§§ 232, 232b StGB) greift die Studie einen hochaktuellen und praxisrelevanten Ausschnitt der europäischen Kriminalpolitik auf. Neben den nationalen Strafvorschriften stehen die europarechtlichen Vorgaben zum Menschenhandelsstrafrecht, namentlich Art. 4 Abs. 1 EMRK, Art. 5 GRCh und die strafrechtsrelevanten Vorschriften der RL 2011/36/EU, im Mittelpunkt der Begutachtung. Die Arbeit zeigt den Regelungsgehalt der im Zuge der Umsetzung der Richtlinie 2011/36/EU neugeschaffenen §§ 232, 232b StGB unter gebührender Beachtung der europarechtlichen Vorgaben zum Menschenhandelsstrafrecht auf und untersucht die Kompatibilität der Strafvorschriften mit den europarechtlichen Vorgaben zum Menschenhandelsstrafrecht. Besondere Bedeutung kommt hierbei der Frage zu, ob die strafrechtliche Definition des Sklavereibegriffs, insbesondere in Hinblick auf eine mögliche Inlandsgeltung, entsprechend den unionsrechtlichen Vorgaben zu erweitern ist.
