Pojęcie praw człowieka wywodzi się z pojęcia praw naturalnych przysługujących wszystkim ludziom. Przekonanie, że każda osoba z racji swojego człowieczeństwa ma prawo do pewnych praw naturalnych, powraca w całej historii ludzkości. Można je prześledzić od tysięcy lat, od Kodeksu Hammurabiego, przez Magna Carta, francuską Deklarację Praw Człowieka i amerykańską Kartę Praw. Podstawowa idea tych praw - fundamentalne zasady, które powinny być przestrzegane w traktowaniu wszystkich mężczyzn, kobiet i dzieci - istnieje w takiej czy innej formie we wszystkich kulturach i społeczeństwach. Współczesnym międzynarodowym wyrazem tych praw jest Powszechna Deklaracja Praw Człowieka. Obowiązkiem rządów jest ochrona praw człowieka ogłoszonych w tej deklaracji. Zgodnie z postanowieniami dotyczącymi praw obywatelskich i politycznych wszystkie rządy mają obowiązek chronić życie, wolność i bezpieczeństwo swoich obywateli. Powinny one zagwarantować, że nikt nie będzie zniewolony ani poddany arbitralnemu aresztowaniu, zatrzymaniu lub torturom. Prawa takie jak wolność myśli, sumienia, wyznania i wolność wypowiedzi należy uznać za prawa człowieka.
