A Lei de Decência nas Comunicações (CDA) de 1996 dos Estados Unidos é uma lei que promove a liberdade de expressão, mas regula conteúdos pornográficos e difamatórios na Internet. A CDA também concede imunidade aos ISPs contra a responsabilidade civil pelo ato de bloquear e filtrar qualquer material considerado ofensivo que tenha sido publicado por terceiros na Internet. Esta proteção contra a responsabilidade civil pelo bloqueio e filtragem de conteúdos na Internet é conhecida como Doutrina do Bom Samaritano. A Doutrina do Bom Samaritano não é uma imunidade absoluta para os ISP contra a responsabilidade por conteúdos de terceiros na Internet, mas uma imunidade qualificada que pode ser perdida uma vez que se comprove que um ISP é negligente ou ajudou ou incentivou o desenvolvimento de conteúdos de terceiros. Esta proposição foi confirmada pela decisão no caso JONES v. DIRTY WORLD ENTERTAINMENT RECORDINGS, LLC, Tribunal Distrital, ED Kentucky 2013. A decisão no caso JONES procura equilibrar a liberdade de expressão de utilizadores anónimos na Internet, garantida pela Primeira Emenda da Constituição dos Estados Unidos, e a proteção da reputação em relação ao direito à privacidade das vítimas lesadas na Internet.
