Amerykańska ustawa o przyzwoitości w komunikacji (CDA) z 1996 r. jest aktem prawnym, który promuje wolność słowa, ale reguluje treści pornograficzne i zniesławiające w Internecie. CDA zapewnia również dostawcom usług internetowych immunitet od odpowiedzialności cywilnej za „blokowanie i filtrowanie wszelkich materiałów uznanych za obraźliwe', które zostały opublikowane przez osoby trzecie w Internecie. Ta ochrona przed odpowiedzialnością cywilną za blokowanie i filtrowanie treści w Internecie znana jest jako „doktryna dobrego samarytanina'. Doktryna dobrego samarytanina nie stanowi absolutnego immunitetu dla dostawców usług internetowych przed odpowiedzialnością za treści stron trzecich w Internecie, ale immunitet warunkowy, który może zostać utracony, gdy zostanie ustalone, że dostawca usług internetowych przyczynił się do powstania treści stron trzecich lub pomógł w ich tworzeniu. Teza ta została potwierdzona wyrokiem w sprawie JONES przeciwko DIRTY WORLD ENTERTAINMENT RECORDINGS, LLC, Sąd Okręgowy, ED Kentucky 2013.
