Inhaltsangabe:Zusammenfassung: Gegenstand der Arbeit ist die Wahl einer optimalen Rechtsform für eine kommunale Weiterbildungseinrichtung einer niedersächsischen Landkreisverwaltung. Behandelt werden dabei die Einrichtungen der Musikschule und der Volkshochschule, die gegenwärtig in verschiedenen Betriebsformen geführt werden. Aufgrund von Sach- und Zweckmäßigkeitsüberlegungen erfolgt im Rahmen der Ausarbeitung eine Zusammenführung der Betriebe zu einem „Haus der Bildung“ in einer gemeinsamen Rechtsform. Nach Prüfung der rechtlichen Voraussetzungen sowie mittels sachlicher Einengung auf die entscheidungsrelevanten Rechtsformen kommen der Zweckverband, die GmbH und der Verein als zu untersuchende Organisationsformen in die engere Auswahl. Für sie wird eine Rechtsformenanalyse und eine sachgerechte Ermessensausübung anhand von Entscheidungskriterien vollzogen. Zum Abschluss erfolgt unter Berücksichtigung der zu erfüllenden Aufgabenbereiche und der Organisationsziele ein Bewertungsverfahren mit Hilfe einer Nutzwertanalyse. Im Ergebnis wird die optimalste und vorteilhafteste Rechtsform für das „Haus der Bildung“ herausgestellt.
