Случаи международного суррогатного материнства вызвали серьезные споры в судах, а также перед ЕСПЧ. Отказ некоторых европейских стран выдавать свидетельство о рождении в случаях рождения ребенка от суррогатного материнства был рассмотрен в рамках ст. 8 ЕКПЧ - право на частную и семейную жизнь. В заключении авторы приводят конкретные предложения по регулированию суррогатного материнства и дают указания на модель законодательства о суррогатном материнстве. В соответствии с этой моделью авторы настоятельно рекомендуют, чтобы суррогатное материнство осуществлялось в строгих условиях, обеспечивающих максимальный уровень защиты прав и достоинства человека.
