A partire dagli anni ’70, l’improvviso aumento delle minacce all’ambiente, unito al miglioramento del modo in cui queste minacce sono state comprese, ha portato a un movimento legislativo senza precedenti. Questa proliferazione legislativa ha interessato tutti i sistemi giuridici, dal diritto nazionale alla legislazione nazionale. Questa pletora di leggi richiede ai giudici un lavoro rigoroso e meticoloso per decifrare la verità che si cela dietro di esse. È per questo che il giudice amministrativo è chiamato a interpretare questi testi per dare loro un senso e uno spirito al fine di garantire la massima protezione dell’ambiente. È chiamato a svolgere il suo ruolo di custode della legge ed è investito del ruolo di buon pastore per l’applicazione delle leggi sulla protezione dell’ambiente. Mentre l’amministrazione è talvolta tentata di trascurare l’ambiente, il giudice è in ultima linea e non può sottrarsi alle regole ambientali.
