Les violations répétées par les professionnels des médias des lois, règlements et règles d’éthique et de déontologie régissant le secteur de la presse ont pour cause essentielle : la méconnaissance de la législation en matière de presse et des règles professionnelles par les intéressés. Une des raisons de ce déficit de professionnalisme est l’exercice du métier de journaliste par les non professionnels. Jean-Claude Guyot et Luc-Adolphe Tiao avaient trouvé que l’efficacité d’un régulateur des médias tient non pas à poursuivre les opérateurs parce qu’ils ne respectent pas une partie de la réglementation ; mais à émettre une recommandation qui détaille comment le régulateur considère qu’il faut agir pratiquement pour appliquer une réglementation qui peut sembler théorique . La présente publication répond à ce besoin de référentiel des normes dans l’exploitation en audiovisuel congolais, et en toute logique, une boussole capable d’indiquer les repères et les marques des précautions à prendre pour une exploitation optimale de l’audiovisuel tant public que privé en République Démocratique du Congo.
