A questão da realização dos direitos individuais à liberdade de circulação é um dos temas mais atuais da nossa época. Ela tem caráter internacional, administrativo e constitucional. A atração pelo Estado de direito está em constante crescimento. As razões para isso são muitas. Em primeiro lugar, está a aplicação prática do princípio da supremacia da lei no domínio da migração externa. A Declaração Francesa dos Direitos do Homem e do Cidadão, de 26 de agosto de 1789, proclamou solenemente no seu ponto 5: A lei só pode proibir os atos prejudiciais à sociedade. Este princípio foi posteriormente desenvolvido no ponto 2 do artigo 29.º da Declaração Universal dos Direitos Humanos das Nações Unidas de 1948: No exercício dos seus direitos e liberdades, cada pessoa só pode ser sujeita às restrições estabelecidas pela lei, exclusivamente com o objetivo de garantir o devido reconhecimento e respeito pelos direitos e liberdades dos outros e satisfazer as justas exigências da moral, da ordem pública e do bem-estar geral numa sociedade democrática.
