La fixation des prix des transactions internationales intra-groupe détermine la répartition des bénéfices entre les entités d’autant plus qu’elles sont soumises à des taux d’imposition différents en fonction de l’État dans lequel elles sont installées. Dans une économie globale où les groupes de sociétés jouent un rôle essentiel, les prix de transfert sont d’une importance capitale, aussi bien pour les Administrations fiscales que pour les contribuables. L’Administration fiscale définit les prix de transfert comme les prix des transactions entre sociétés d’un même groupe et résidentes d’Etat différents. Ils s’articulent autour du principe dit de pleine concurrence définie par l’article 9 du modèle de convention fiscale de l’Organisation de Coopération et de Développement Economique (OCDE) et du modèle de convention des Nations Unies. Il s’agit en substance de s’assurer que deux entreprises ne sont pas liées, dans le cadre de leurs relations commerciales par des conventions convenues différentes de celles qui seraient convenues entre entreprises indépendantes.
