Cztery lata później, po orzeczeniu Gregg przeciwko Gruzji, które uznało nowy status Gruzji kary śmierci za konstytucyjny, większość państw, które wcześniej nakładały karę śmierci, przywróciło ją. Autor argumentuje, że w obecnym kształcie kara śmierci jest nadal stosowana w sposób arbitralny i narusza klauzule `` równej ochrony ' i `` należytego procesu ' czternastej poprawki do konstytucji USA.
