Il rapporto tra l’ambiente e le attività dell’industria mineraria in Mozambico è regolato da una legislazione specifica, come il Decreto 26/2004 del 20 agosto, il Regolamento ambientale per le attività minerarie, le Norme di gestione ambientale di base per le attività minerarie approvate con il Diploma ministeriale 189/2006 dedicato in particolare alle attività minerarie di livello 1, nonché dalla legislazione ambientale generale (Legge quadro sull’ambiente - 20/9). In altre parole, le attività minerarie di livello 1 devono rispettare le norme di gestione ambientale di base; Le attività minerarie di livello 2 devono rispettare la Legge sulle miniere (Legge 14/2002 del 26 giugno), articolo 37, numero 1, e il Regolamento ambientale per le attività minerarie (Decreto 26/2004 del 20 agosto), articolo 1, numeri 1, 2 e 3. Sebbene il Regolamento ambientale per le attività estrattive non stabilisca che le attività di livello 1 e 2 debbano richiedere una licenza, si può presumere che tutte le attività che potrebbero causare un danno ambientale debbano essere sottoposte a una valutazione preliminare.
