Diese Dissertation ist eine Befragung des Status quo, der in der gesetzlichen Regelung der wichtigsten Strafen vorherrscht, wobei der Schwerpunkt ausschließlich auf der Analyse der Freiheitsstrafe liegt. Ausgehend von einer historischen Betrachtung des Instituts der Freiheitsstrafe wird die Theorie der Strafe analysiert, um die Frage zu beantworten, welche der theoretischen Hypothesen (möglicherweise) zur Konzeption der Anwendung einer Freiheitsstrafe herangezogen werden kann. Die Arbeit analysiert dann das Problem des Gefängnisses, prangert die Desillusionierung an, die die Weihe des Instituts im heutigen Strafrecht bedeutet, seziert die Unangemessenheit seiner Anwendung und endet mit einem Vorschlag zur Lösung des vorgestellten Problems in Form einer juristisch-humanistischen Gleichung.
