El «código de los piratas» fue popularizado por piratas como John Phillips, Edward Low y Bartholomew Roberts. Los bucaneros se guiaban por los artículos del barco al que pertenecían que, entre otras cosas, regían la conducta de la tripulación. Estos «artículos» operaron como una jurisdicción independiente de cualquier nación, y se denominaron de diversas maneras: «Chasse-Partie, Charter Party, Custom of the Coast o Jamaica Discipline». No obstante, el término que se ha popularizado a lo largo de la historia es «El código de los piratas». Los artículos de este código variaban de un capitán a otro, y a veces incluso de un viaje a otro, pero por lo general se asemejaban en que incluían cómo debían de regirse las relaciones entre los tripulantes, especificaciones sobre el reparto del botín que le correspondía a cada miembro de la tripulación y consideraciones económicas sobre la indemnización de los heridos.
