Inhaltsangabe:Einleitung: In der vorliegenden Diplomarbeit wird auf die Schwierigkeiten bei der Abgrenzung zum Strafrecht und der vorsätzlichen Hinterziehung mit der Möglichkeit der echten Selbstanzeige eingegangen. Das geschützte Rechtsgut wird behandelt. Die Stellung des Steuerberaters wird untersucht. Der äußere objektive Tatbestand wird angesprochen und gefragt, wann Steuern verkürzt sind. Es wird auf den möglichen Täterkreis eingegangen. Der Begriff der Leichtfertigkeit und die damit zusammenhängende Sorgfaltspflicht wird ausführlich behandelt. Es wird kurz auf Konkurrenzfragen, die Geldbuße und die Verjährung eingegangen. Bei der Selbstanzeige wird besprochen, was eine Teilselbstanzeige im Gegensatz zu einer Selbstanzeige in Stufen ist, wer eine Selbstanzeige erstatten kann und wo. Ebenso wird darauf eingegangen, welche Form und Arten der Berichtigung es gibt und was unter einem wesentlichen Beitrag verstanden wird. Daran anknüpfend werden die nicht ausreichenden Handlungen genannt. Auch der Ausschlussgrund ist bearbeitet worden. Ebenso wie auch auf die fristgerechte Nachzahlung eingegangen wird. Zum Schluss wird noch ein Vergleich mit der Fremdanzeige und der Berichtigung nach § 153 AO gemacht.
