Inhaltsangabe:Einleitung: Das Internet ist mittlerweile aus dem Leben vieler Menschen nicht mehr wegzudenken. Die Zahl der Nutzer steigt täglich. Diese Entwicklung prägt in sehr großem Maße die Arbeitswelt. Obwohl immer mehr Arbeitsplätze über einen Internetzugang verfügen, sind die rechtlichen Rahmenbedingungen noch nicht umfassend geklärt. So ist beispielsweise strittig, ob der Arbeitgeber die E-Mails seiner Beschäftigten lesen darf, das Surfverhalten protokolliert werden darf oder inwieweit ein Arbeitnehmer das Recht hat, privat das Internet am Arbeitsplatz zu nutzen. Im Rahmen der vorliegenden Arbeit sollen diese und andere Fragen untersucht und darüber hinaus Handlungsempfehlungen gegeben werden, inwieweit die missbräuchliche Nutzung eingeschränkt werden kann. Dies sollte für Unternehmen von großem Interesse sein, um überwiegend die Vorteile des Internets nutzen zu können. Sobald das Internet in beträchtlichem Umfang privat genutzt wird und darüber hinaus weitere damit verbundene Probleme wie das Begehen von Straftaten am Arbeitsplatzcomputer (z.B. Kinderpornografie) hinzukommen, kann das Internet nicht nur zu einer großen Kostenfalle werden, sondern auch das Ansehen des Unternehmens in der Öffentlichkeit schädigen. Neben den arbeitsrechtlichen Fragen wird der Datenschutz bezüglich der privaten Internetnutzung am Arbeitsplatz untersucht. Es wird dargestellt, inwieweit das Grundrecht auf informationelle Selbstbestimmung des Arbeitnehmers mit dem Direktionsrecht des Arbeitgebers in Konflikt steht und welche Lösungsmöglichkeiten sich ergeben. Darüber hinaus wird die steuerrechtliche Bewertung der privaten Internetnutzung in einem Arbeitsverhältnis erläutert.
