Die moderne Sklaverei hat ihre eigenen Merkmale und darf nicht mit der Realität der klassischen Antike oder sogar des kolonialen Brasiliens verwechselt werden. Tatsächlich handelt es sich um eine subtile und perverse Praxis, die radikal bekämpft werden muss. Trotz der Ermittlungen, Anzeigen und Prüfungen durch die dafür zuständigen Behörden gibt es immer noch unzählige Arbeitnehmer, die unter sklavenähnlichen Bedingungen leben müssen. Die individuelle Freiheit und die physische und psychische Unversehrtheit erfordern eine differenzierte strafrechtliche Behandlung. Die vorliegende Studie geht von der Auffassung des Obersten Bundesgerichts aus, die dieses während der Verhandlung der Untersuchung Nr. 3412/AL zur Analyse des in Artikel 149 des Strafgesetzbuches vorgesehenen Straftatbestands vertreten hat.
