Inhaltsangabe:Einleitung: In den letzten zwei Jahren ist in der Presse immer wieder ein umstrittenes Thema zu finden. Hier liest man in den Schlagzeilen so etwas wie „Geschäftsbanken ziehen sich aus der Kreditfinanzierung des Mittelstands zurück“ (Financial Times 27.04.00), „die Kredite für den Mittelstand werden immer teurer – Ratings und Eigenkapitalvorschriften gehen zu Lasten kleiner Arbeitgeber“ (FAZ 07.03.00) oder „Firmenkundenkreditgeschäft als Wertfalle deutscher Banken“ (FAZ 09.09.99). Alle diese Pressemitteilungen verschiedener Autoren wie Bankenvorstände, Politiker, Manager etc. resultieren von der 1998 vorgestellten, und im Juni 1999 schließlich herausgegebenem Konsultationspapier des Ausschusses für Bankenaufsicht der Bank für internationalen Zahlungsausgleich (BIZ) in Basel. Dieses Konsultationspapier, auch „Baseler Akkord“ bezeichnet, beinhaltet diverse gesetzliche Neuregelungen des Bankenrechts in der Europäischen Gemeinschaft, welche in nationales Recht übernommen werden sollen. Zur Zeit gelten in Deutschland noch die Gesetze basierend auf den ersten Baseler Akkord (Basel I). Diese Richtlinien gehen auf eine im Jahr 1988 in Basel zwischen den großen Industrienationen vereinbarte Regelung zurück und sind in Deutschland 1992 mit der Verabschiedung der vierten KWG-Novelle bindendes Recht geworden. Grund für die Neuerung der Vorschriften für die Bankenwelt sind die Finanzkrisen in Asien und auch in Russland. Hier hat man erkannt, wie anfällig die Wirtschaft, und nicht nur die europäische Wirtschaft, sondern die gesamte Weltwirtschaft auf solche Krisen reagiert. Um dem entgegenwirken und solche Zusammenbrüche möglichst zu vermeiden, beschloss man, den Finanzmarkt weiter zu festigen, indem man eine höhere und besser angepasste Risikoabsicherung der einzelnen Bankgeschäfte vornimmt.
