Inhaltsangabe:Einleitung: Thema dieser Arbeit ist die Richtlinie 93/6/EWG des Rates der Europäischen Gemeinschaften (EG) vom 15. März 1993 über die angemessene Eigenkapitalausstattung von Wertpapierfirmen und Kreditinstituten, kurz 'Kapitaladäquanzrichtlinie' genannt. Mit dieser Richtlinie sollen die Eigenmittelanforderungen für den Wertpapierbereich innerhalb des Europäischen Binnenmarktes geregelt werden, um dadurch Wettbewerbsverzerrungen zu verhindern. Gang der Untersuchung: Ziel dieser Arbeit ist es, die Kapitaladäquanzrichtlinie anhand einer umfassenden Darstellung unter wettbewerbspolitischen und bankaufsichtlichen Gesichtspunkten kritisch zu beurteilen. Im ersten Abschnitt wird dabei eine Einordnung dieser Richtlinie in den Komplex der EG-Richtlinien zur Harmonisierung des Europäischen Bankenmarktes vorgenommen und auf international vergleichbare Initiativen verwiesen. Der zweite und der dritte Abschnitt dieser Arbeit dienen zur Darstellung der wesentlichen Grundbegriffe und Verfahrensweisen auf die im Regelwerk der Kapitaladäquanzrichtlinie zurückgegriffen wird. Im darauffolgenden Abschnitt werden die Methoden zur Ermittlung der Eigenmittelunterlegung des Wertpapiergeschäftes dargestellt und mit den entsprechenden Vorschlägen des Marktrisiko-Konsultationspapieres verglichen. Insbesondere die Verwendung von Ratings zur Bonitätsermittlung und die Durationmethode zur Ermittlung des Zinsänderungsrisikos werden in diesem Zusammenhang explizit ausgearbeitet und beurteilt. Den Abschluß dieser Arbeitet bilden eine Analyse und eine kritische Würdigung der Auswirkungen der Kapitaladäquanzrichtlinie auf betroffene Unternehmen und deren Wettbewerbssituation.
