Als ersten Schwerpunkt nimmt die Autorin die Beschlagnahmemöglichkeit von Ermittlungsunterlagen durch Strafverfolgungsbehörden in den Blick. Die kritische Würdigung der §§ 97, 160a StPO zeigt, dass de lege lata ein partieller Beschlagnahmeschutz greift. Einen weiteren Schwerpunkt bildet die Prüfung eines strafprozessualen Verwertungsverbotes aufgrund des Spannungsverhältnisses zwischen der Selbstbelastungspflicht der Arbeitnehmer bei Befragungen im Rahmen unternehmensinterner Ermittlungen und dem nemo-tenetur-Grundsatz. Ein solches Verwertungsverbot folgt aus der analogen Anwendung des § 630c Abs. 2 S. 3 BGB.
