Inhaltsangabe:Einleitung: Der deutsche Gütertransportmarkt befindet sich seit dem 01.07.1998 in einer Phase des Umbruchs. Durch die Reform des veralteten und zersplitterten deutschen Transportsrechts ergeben sich neue rechtliche Rahmenbedingungen für das Frachtführer- und Speditionsgewerbe. Die bisher in unterschiedlichen Gesetzen, Verordnungen und Abkommen geregelten Transportbestimmungen werden durch das Transportrechtsreformgesetz (TRG) vereinheitlicht und im Handelsgesetzbuch zusammengefaßt. Die Haftungsregelungen bildeten das Kernstück des TRG. Gang der Untersuchung: Die vorliegende Diplomarbeit beinhaltet insofern eine Darstellung und Kommentierung der haftungsrechtlichen Änderungen im Fracht- und Speditionsgeschäft. Ausgehend von einer Einführung in das Rechtsgebiet des Transportrechts (Teil A) werden in den Abschnitten B und C jeweils das Haftungsrecht im Fracht- und Speditionsgeschäft im Vergleich zu der bis zum 01.07.1998 geltenden Rechtslage beschrieben und anhand von Beispielen und Grafiken veranschaulicht. Jedem einzelnen Abschnitt ist eine ausführliche Einleitung vorangestellt, die eine systematische Einordnung, Begriffsdefinitionen, Haftungsprinzipien, Beweislastfragen und Abgrenzungsmerkmale der verschiedenen Vertragsformen bzw. -partner enthält. Bei der Kommentierung des TRG wird u.a. auf den gesetzlich zulässigen Gestaltungsspielraum für abweichende Geschäftsbedingungen ('Korridorlösung') eingegangen. Im Teil D werden die Auswirkungen des TRG in der Praxis für die beteiligten Parteien Verlader und Transport-/Speditionsgewerbe erläutert.
