Danach wird der Inhalt der gesetzlichen Regelungen insbesondere im Hinblick auf den Außenseiterschutz skizziert; die gerichtliche Durchsetzung von Schadensersatzansprüchen wird dabei nur eingeschränkt angesprochen, um den Umfang der Ausarbeitung nicht zu sprengen. Im Rahmen der Darstellung des Schutzkonzeptes wird auf die Funktion des Abhängigkeitsberichts tiefer eingegangen, insbesondere auf die Frage um das Für und Wider seiner Vertraulichkeit. Abschließend erfolgt eine Auswertung der rechtspolitischen Diskussion um den faktischen Konzern.
