Inhaltsangabe:Einleitung: „Seit Friedrich dem Großen ist noch kein Pfandbrief ausgefallen.“ Die Sicherheit der Anlage ist weltweit das Argument für den Pfandbrief „made in Germany“. Er genießt bei Investoren ein hohes Ansehen und hat sich innerhalb seiner 236-jährigen Geschichte zu einem Exportschlager des deutschen Finanzmarktes entwickelt. Dieser Erfolg ist das Ergebnis seiner klaren gesetzlichen Grundlage. Der Wegfall von Anstaltslast und Gewährträgerhaftung für öffentlich-rechtliche Kreditinstitute veranlasste den Gesetzgeber, die bisherigen Rechtsgrundlagen für die Emission von Pfandbriefen, Hypothekenbankgesetz (HBG), Gesetz über die Pfandbriefe und verwandten Schuldverschreibungen öffentlich-rechtlicher Kreditanstalten (ÖPG) und Schiffsbankgesetz (SchBG), abzuschaffen und durch das neue Pfandbriefgesetz (PfandBG), das am 19.07.2005 in Kraft trat, zu ersetzen. Endet jetzt die erfolgreiche Ära des Pfandbriefs? Welche Änderungen bringt das neue Gesetz? Wie wirken sich diese auf die Marktteilnehmer aus? Der Pfandbrief musste sich in seiner Entwicklung immer neuen Herausforderungen stellen. Die fortschreitende Europäisierung des Pfandbriefgedankens steigert den Wettbewerbsdruck für das deutsche Vorzeigeprodukt. Viele europäische Nachbarstaaten haben in den letzten Jahren Rechtsrahmen für pfandbriefähnliche Produkte geschaffen. Emittenten aus neuen Ländern drängen auf den Markt. Wird der Pfandbrief zukünftig seine Spitzenstellung im europäischen Wettbewerb behaupten können? Der Krisenfall um die Allgemeine Hypothekenbank Rheinboden (AHBR) im Oktober 2005 hat das makellose Image des Pfandbriefs angekratzt. Keine Bank war mehr bereit, AHBR-Pfandbriefe von Anlegern anzukaufen. Anlass genug für viele Marktteilnehmer, kritisch zu hinterfragen: Ist der Pfandbrief wirklich so sicher, wie immer behauptet wird?
