Com o desenvolvimento social e biotecnológico novos fenômenos surgem, exigindo do Direito respostas para conflitos e situações não antes pensadas. Nesse contexto, encontra-se a técnica de Reprodução Assistida. Apesar dessa técnica ter surgido há mais de 4 décadas, conflitos cada vez mais complexos emergem no que tange ao uso dessa tecnologia. Desse modo, ao se constatar que casos de disputa acerca da destinação do embrião criopreservado têm sido reportados nos mais variados países (Reino Unido, Itália, Israel, Brasil, Estados Unidos etc.), resultando em diferentes resoluções para esses conflitos, surge a indagação se, no cenário brasileiro, caberia revogar o consentimento informado para implante em útero do embrião criopreservado. Para tal, propõe-se a hipótese de que caberia sim, no contexto brasileiro, revogar tal consentimento, tendo em vista o status do embrião criopreservado na ordem pátria, bem como a autonomia reprodutiva como direito fundamental da personalidade, alicerçando a prerrogativa da parte que não deseja mais seguir com a RA. A pesquisa evidencia a necessária tutela jurídica dos direitos existenciais e a liberdade de cada um para desenvolver o projeto de vida que deseja dentro da ordem jurídica na qual se está inserido. 10
