The duty of care is a pervasive concept in today’s employment relationships: from workplace accidents to burnout, all employees may be affected by these risks. As employers have a duty of care towards their employees, they may be held liable. Firstly, we will examine the legal nature of the duty of care: is it a duty of means or a duty of result? The second part of this book will outline the material and human resources available to the employer to fulfil their duty of care.
