Abuja em vez de Arusha! É este o resumo deste livro. Trata-se de uma abordagem analítica e comparativa de um estudo aprofundado da situação atual do acesso direto dos indivíduos aos dois tribunais de proteção dos direitos humanos criados nestas cidades. É certo que a questão do recurso direto aos órgãos de proteção dos direitos humanos é tão antiga como o próprio sistema africano. Mas foi reavivada pelo Protocolo de Ouagadougou. Este prevê o recurso direto apenas na aparência. O Tribunal de Arusha continua a ser de difícil acesso. Os particulares só podem aceder a ele por duas vias: ou indiretamente, através do tímido intermediário da Comissão de Banjul, contra os 34 Estados 'virtuosos' que são partes no seu Protocolo, ou, extraordinariamente, diretamente contra os 8 Estados 'corajosos' que reconheceram a sua jurisdição obrigatória por força do nº 6 do artigo 34º do seu Protocolo. Seja qual for a via escolhida, o documento enumera os numerosos obstáculos que se opõem à realização de Arusha. Estes são analisados em comparação com o acesso mais flexível, universal e obrigatório oferecido pelo Tribunal de Abuja aos requerentes individuais da África Ocidental.
