In recent years, cyber fraud has grown exponentially as an issue affecting businesses and individuals worldwide, causing very significant financial losses as well as reputational harm and embarrassment to the victims. However, well-established principles of law can be adapted to meet the new challenges posed by cyber fraud. The Court has shown willingness to develop its jurisdiction to give the victims of cyber fraud the tools needed to identify, trace, seize and recover the proceeds of frauds perpetrated against them. In addition to pursuing the immediate perpetrators of the cyber fraud, there are also numerous routes by which a victim can recover their loss from various third parties who may be held responsible for the fraud.This book is a practical handbook to assist the reader in navigating the peculiarities of claims in respect of cyber fraud. It acts as a guide on the procedure and substantive law relating to this burgeoning practice area, assisting the practitioner who is dealing with cyber fraud litigation – often under strict time pressures.ABOUT THE AUTHORMatthew is a barrister at Twenty Essex with a broad commercial practice. Clients instruct him to advise or act in national and international litigation and arbitrations, with recent cases having had a particular focus on disputes concerning civil fraud, company law and insolvency, and shipping and commodities.Matthew has first-hand experience of cyber fraud litigation in its various guises. He acted in CMOC v Persons Unknown and others [2018] EWHC 2230 (Comm), an action to trace and recover money stolen by cyber fraudsters, and notable as being the first-known occasion that a worldwide freezing injunction has been granted against ‘persons unknown’.
