El divorcio eclesiástico fue la vía legalmente institucionalizada en Chile para resolver los conflictos conyugales hasta 1884. Durante la segunda mitad del siglo XIX, el matrimonio era una institución social definida por el derecho canónico en cuanto a su validez, nulidad y separación, y sus efectos sobre la persona y los bienes de los cónyuges eran regulados por el Código Civil. De esta forma, ambas justicias –la eclesiástica y la civil- se combinaron para resolver los conflictos conyugales. Bajo este marco jurídico, la autora estudia el quiebre del matrimonio a través de los pleitos de divorcio y cómo los esposos contendientes esgrimieron un concepto de orden conyugal socialmente aceptado y legalmente definido en defensa de sus respectivas posturas. La ruptura marital muestra la tensión entre la obediencia de la esposa y el deber de protección del marido expresada en las demandas por maltrato y abandono. La discusión sobre los límites de las prerrogativas de mando y corrección que competían al hombre en el ejercicio de su potestad marital revela un concepto de matrimonio jerárquico que establecía la subordinación legal de la mujer y cómo ella utilizó el divorcio como un recurso de protección sobre su persona y su patrimonio.
