Written in 2012, this work is a research project that aims to present the reader with an understanding of the legal concept of the state of miserability provided for in § 3 of art. 20 of Law 8.742/93, popularly known as the Organic Law on Social Assistance - LOAS, and its possible flexibilisation from the perspective of the decisions handed down by the Appeals Panel of the Special Federal Courts of the Judicial Section of Espírito Santo.
