La recherche de la préservation de la dignité humaine a toujours été l’une des préoccupations majeures de tous les Etats au point qu’elle caractérise même les relations interétatiques. Si jadis, ils étaient pratiquement une philosophie idéaliste, les deux guerres qu’a connue la planète ont réussies non seulement à bouleverser le système international mais aussi à en faire des droits au vrai sens du terme. Ainsi, trois années après la fin de la seconde guerre, les Etats vont commencer à bâtir un système de protection des droits de l’homme. Le 10 décembre 1948, la Déclaration Universelle des droits de l’homme voit le jour et dix-huit années plus tard deux textes (pactes) viendront donner à cette déclaration un caractère obligatoire vis-à-vis des Etats. Les Etats africains ainsi que l’Union Africaine n’échappent pas à cette recherche universelle. Un système de protection des droits de l’homme a été créé au sein du territoire constituant l’Union Africaine. Système qui prend en compte les valeurs morales africaines. Notons que ce système a justement pour vocation de préserver et de rétablir les citoyens africains de leur dignité.
