Desde a guerra de Novembro de 1996, passaram mais de duas décadas desde que a República Democrática do Congo foi palco de graves violações e abusos dos direitos humanos e do direito humanitário internacional direitos humanos e direito humanitário internacional. Crimes internacionais como estupro, tortura e homicídio em massa têm sido cometidos em quase todo o país e continuam a ser perpetrados durante os vários conflitos que têm ocorrido. Apesar de a RDC ser parte nos vários instrumentos internacionais de protecção das populações civis e daqueles que já não participam nos combates, como as quatro Convenções de Genebra de 1949 e os seus protocolos adicionais, as suas populações civis continuam a ser alvo de vários criminosos de auto-estrada. Estes instrumentos internacionais, o mais recente dos quais é o Estatuto de Roma, obrigam os Estados Partes a utilizar o seu sistema judicial para punir os autores destas violações dos direitos humanos e do direito humanitário internacional.Infelizmente, a impunidade continua endémica porque o sistema judicial congolês é letárgico e cronicamente incapaz de reprimir estas várias violações.
