O presente estudo teve o objetivo de analisar a postura do Supremo Tribunal Federal quando do julgamento da Reclamação Constitucional 4.335 tendo como pressuposto sua função dentro do Estado Democrático de Direito brasileiro, principalmente no que se refere à cidadania constitucional. A justificativa para tal análise reside no fato de que, no atual Estado Democrático de Direito, por sua vez baseado na Constituição Federal de 1988, o Supremo Tribunal Federal, enquanto órgão de cúpula do Poder Judiciário, é o responsável por mediar situações relativas à judicialização da vida em sociedade, estabelecendo um elo não somente entre a sociedade e a norma constitucional mas, principalmente, entre o Estado e a cidadania constitucional. Para tanto, o estudo remonta, histórica e politicamente, as bases do Estado Democrático de Direito e a formação da identidade e da cidadania constitucional segundo Habermas, assim como apresenta as funções do Poder Judiciário no atual contexto brasileiro e o instituto da mutação constitucional. Posteriormente, ao abordar como objeto de estudo a Reclamação Constitucional 4.335, tem-se uma análise acerca da ação do Supremo Tribunal Federal quando da possibilidade de alteração do texto constitucional, discutindo sua legitimidade e demonstrando que, independente do caso em julgamento e das possibilidades de sua atuação, o Supremo Tribunal Federal não deve, de forma alguma, afetar ou suprimir a cidadania constitucional e a democracia, pilares do atual Estado brasileiro. 10
