Niniejsza praca dotyczy zniesienia ogólnego zakazu udzielania dodatkowych korzyści w Austrii, który stanowił naruszenie dyrektywy wydanej przez UE. Sąd Najwyższy orzekł, że dodatek jest niedopuszczalny tylko wtedy, gdy jest wprowadzający w błąd, agresywny lub w inny sposób nieuczciwy, przy czym oceniając zachowanie konsumenta, stosuje tak wysokie standardy, że są one znacznie surowsze niż przewidziane w odpowiedniej dyrektywie UE. W związku z tym niniejsza praca, w szczególności poprzez analizę odpowiednich tekstów prawnych, ale przede wszystkim poprzez krytyczną ocenę istotnych orzeczeń Europejskiego Trybunału Sprawiedliwości, austriackiego Sądu Najwyższego i niemieckiego Federalnego Trybunału Sprawiedliwości, bada, czy obecna sytuacja w Austrii jest zgodna z bezwzględnie obowiązującymi wymogami UE. Wyniki pracy wskazują, że obecna sytuacja prawna, ze względu na model konsumenta, narusza prawo wspólnotowe, a także powoduje poważne negatywne skutki w praktyce.
