In dieser Studie wird die Entwicklung der Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte (EGMR) zum Schutz des Familienlebens und der Rechte des Kindes zwischen 2020 und 2025 analysiert und ihre Auswirkungen auf das spanische Rechtssystem bewertet. Mithilfe einer gemischten Methodik, die eine Dokumentenanalyse von 247 EGMR-Urteilen, eine systematische Überprüfung der aktuellen Rechtsprechung und halbstrukturierte Interviews mit 45 Fachleuten des Familienrechts umfasst, werden sechs kritische Bereiche ermittelt: das Recht des Kindes auf Anhörung, internationale Kindesentführung, Pflege- und Adoptionssysteme, Anerkennung der Elternschaft, Geschlechtsidentität bei Minderjährigen und Leihmutterschaft. Die Ergebnisse zeigen einen konsolidierten Trend hin zu einer sich weiterentwickelnden Auslegung von Artikel 8 der Europäischen Menschenrechtskonvention (EMRK), wobei das Wohl des Kindes als Leitprinzip im Vordergrund steht. Die Zahl der Verurteilungen von Staaten wegen Verstößen gegen das Recht des Kindes auf Anhörung ist um 34 % gestiegen, und die Rechtsprechung in Fällen internationaler Entführungen ist restriktiver geworden. Die Studie unterstreicht die Notwendigkeit einer Harmonisierung der Rechtsvorschriften in Spanien.
