Die Schiedsgerichtsbarkeit stellt eine Delegation von Privatautonomie dar. Michel Schenk untersucht die grundrechtliche Privatautonomie als Grundlage der Schiedsgerichtsbarkeit und leitet deren Grenzen aus staatlichen Schutzpflichten her. Dabei berücksichtigt er auch die besondere Problematik einer Schiedsgerichtsbarkeit, bei der sich der Staat als Schiedspartei beteiligt.Der Autor:Michel Schenk promovierte an der Philipps-Universität Marburg und ist derzeit Rechtsreferendar am LG Kleve.
