Em França, os juízes são considerados funcionários públicos que exercem um dos poderes soberanos do Estado e, por conseguinte, apenas os cidadãos franceses são elegíveis para o cargo de juiz. O poder judicial francês é independente e goza de uma proteção estatutária especial face ao poder executivo. Os procedimentos para a nomeação, promoção e destituição de juízes variam consoante se trate de um processo judicial, administrativo ou de um tribunal de contas. As nomeações de juízes devem ser aprovadas por um painel especial, o Conselho Superior da Magistratura, composto por outros juízes do tribunal de destino. Uma vez nomeados, os juízes são vitalícios e não podem ser destituídos sem um processo disciplinar específico conduzido perante o Conselho, com um processo justo.
