Estes são o médico, que é consultado em primeiro lugar e prescreve os medicamentos; o farmacêutico, que distribui os medicamentos; e o enfermeiro, que administra os medicamentos. Uma vez que o farmacêutico é um dos actores deste circuito, coloca-se a questão de saber se, segundo o direito congolês, o farmacêutico pode ser responsabilizado por danos ocorridos quando distribuiu os medicamentos em execução de uma prescrição médica. Para responder a esta questão, a nossa análise incide, por um lado, sobre as condições de responsabilidade do farmacêutico no direito congolês e, por outro, sobre a aplicação da responsabilidade do farmacêutico no direito congolês. Parece que a responsabilidade do farmacêutico é menos eficaz perante os tribunais de Bukavu porque as vítimas ainda têm a ideia de que a responsabilidade recai sobre o prescritor da receita médica.
